The order was passed by Judicial Magistrate Ankit Garg at the Patiala House Court after hearing arguments from both prosecution and the defence.

The court directed that Makkad be released on a personal bond of Rs 1 lakh along with two sureties of the same amount. It also ordered Makkad to surrender her passport, restricting her from leaving the country without prior permission.

On September 25, the court reserved the order in her bail plea and also questioned the police on what action they had taken against the ambulance driver, who was going to a hospital to pick up a body when it passed by the accident spot, for refusing to help the victims of the BMW car accident on September 14.

After scanning the CCTV footage of the accident site, the court expressed displeasure over the fact that the ambulance driver, who had reached the spot within 30 seconds, did not help the victims.

Makkad was arrested on September 15 and was initially sent to two-day judicial custody. On September 17, the Delhi court extended her judicial custody till September 27.

Notably, Navjot Singh (52), Deputy Secretary in the Department of Economic Affairs, Ministry of Finance, died and his wife Sandeep Kaur suffered injuries after a BMW hit their motorcycle in Dhaula Kuan here on September 14. The couple was returning home after visiting Bangla Sahib Gurdwara.

A case was registered against Makkad under Sections 281 (drive or ride in a rash or careless way that endangers human life), 125-B (anyone who carelessly endangers human life or safety—whether or not harm is caused), 105 (culpable homicide not amounting to murder) and 238 (deliberately conceal evidence or provide false information to protect the offender) of the Bharatiya Nyaya Sanhita.
