Swati Maliwal assault case: Court dismisses Bibhav Kumar’s revision pleas
A Delhi court on Thursday dismissed the pleas of Bibhav Kumar, a close aide of former Chief Minister Arvind Kejriwal, against the cognisance of the chargesheet in the alleged assault case involving AAP MP Swati Maliwal.
Additional Sessions Judge Raj Kumar also rejected the Delhi Police’s revision plea challenging a trial court order from November 2023, which had directed the prosecution to provide a list of seized but unused material objects in the case.
“Considering the submissions of the counsel for the accused that he was not pressing the revision plea, and given that the charge sheet is complete, I find no merit in the petition. It is accordingly dismissed,” the judge stated.
The court was hearing three separate pleas in the matter. In an order dated January 29, it noted that Kumar’s counsel had chosen not to pursue his revision plea against the magistrate’s cognisance of the chargesheet.
The second plea, which challenged the transfer of the case to the sessions court, was also dismissed, with the judge ruling that the trial court’s decision had “no infirmity, illegality, or impropriety.”
Similarly, Delhi Police’s revision plea was rejected as "devoid of merit." Kumar, accused of assaulting Maliwal on May 13, 2024 at the Chief Minister’s official residence, is currently out on bail.
