Balancing act: SC stays some key provisions of Waqf law

THE Supreme Court’s interim order regarding the Waqf (Amendment) Act, 2025, has been welcomed by the Union government as well as the Opposition. Striking a delicate balance, the court has put on hold some key provisions of the Act, including a clause which stipulates that only those practising Islam for the last five years can dedicate a property as Waqf. However, it has refused to stay the entire law, stating that “presumption is always in favour of constitutionality of a statute”. The ruling BJP is relieved that the Act is apparently no longer in danger of being declared unconstitutional, while the Congress claims that the ‘divisive’ agenda underlying the law has been exposed.
