The Punjab and Haryana High Court has summoned Nuh Superintendent of Police (SP) following the failure of police officials to appear before the trial court for the recording of their testimonies in a dowry death case.
Justice Sumeet Goel asserted a disturbing aspect of the matter was required to be looked into. A perusal of the interim orders passed by the trial court showed that the police officials concerned were not turning up for having their testimonies recorded despite the issuance of bailable/non-bailable warrants against them.
“Keeping in view the entirety of the facts and circumstances of the case, the SP, Nuh, is directed to remain present in court, along with his clarificatory affidavit, on the next date of hearing,” Justice Goel asserted, while fixing the case for further hearing on October 15.
Justice Goel was hearing a petition for grant of regular bail to an accused in a case registered on June 25, 2022, for the offences punishable under Sections 304-B and 234 of the IPC at Rozka Meo police station in Nuh district.
Justice Goel observed the petitioner was arrested on September 15, 2022. The investigation was carried out and challan presented on November 7, 2022. A total of 15 prosecution witnesses were cited, out of which seven stood examined.
“A perusal of the zimni orders passed by the trial court brought on record clearly reflect that the police official(s) concerned are not repeatedly turning up for having their testimonies recorded as prosecution witnesses despite bailable/non-bailable warrants having been issued against them,” Justice Goel asserted.
