Hisar court rejects bail plea of suspended Assistant Professor

Thought-provoking Opinions, Expert Analysis, In-depth Insights and other Member Only BenefitsThe court of Additional Sessions Judge Madhulika today dismissed the regular bail application of suspended Assistant Professor Radhey Shyam, who is among the eight accused in an incident of brutal assault on protesting students at Chaudhary Charan Singh Haryana Agricultural University (HAU).
He was arrested in the case of lathicharge on the students, which led to injuries to some students who were staging a demonstration to protest the cut in scholarship and Land Development (LDV) seats for the students on June 10.
The court, while citing the serious nature of the allegations against him, observed that given the gravity of the offence, and the risk that "he might tamper with evidence or abscond if released, it is not inclined to grant bail at this stage".
Radhey Shyam, a resident of Chaudhriwali village in Hisar, applied for regular bail after being arrested on June 15 in connection with an FIR registered on June 11 under Sections 110, 190, 191(2), 191(3), and 351(3) of the Bharatiya Nyaya Sanhita on the complaint of a student Deepanshu.
The complainant had alleged that Radhey Shyam, along with CSO Sukhbir Singh and HAU guards, attacked students with sticks and lathis near the residence of the Vice-Chancellor. Several students, including the complainant, suffered grievous injuries and were taken to the General Hospital, Hisar.
Public Prosecutor Rakesh Kumar and counsel MS Nain opposed the bail, stating that seven students were injured and videographic evidence showed the accused and others assaulting them. It was also revealed that the accused, though not posted in Hisar, was present on the campus without authorisation at the time of the incident. Moreover, they alleged the manipulation of the medical records of the injured students under the influence of the university administration. While Radhey Shyam is the main accused, the co-accused are still absconding.
