Suspecting Haryana police officials’ involvement, CBI books 4 for cheating

As “grave allegations” have been levelled against senior state police officials, the CBI here has booked four people for cheating and forgery on the directions of the Punjab and Haryana High Court.

Jagbir Singh, director, Symbiosis Group of Companies, had filed a complaint on October 29, 2022, against Vinay Aggarwal, Sanjeev Aggarwal, Dr Komal Khanna and Nishant Sareen for cheating, forgery, criminal breach of trust, criminal conspiracy and criminal intimidation at the Sector 20 police station, Panchkula. He had alleged that Vinay, who was posing as a senior IPS officer in the Intelligence Bureau (IB), had extorted Rs 1.49 crore from him, and forced him to enter into a business partnership with Nishant’s friend Komal. Nishant is an Assistant Drugs Controller in HP.

In 2023, Jagbir had moved the Punjab and Haryana High Court stating that the Haryana Police officials were harassing him to withdraw the case. He alleged that an old FIR dated February 23, 2022, had been revived against him, though the police had filed a closure report.

During the court proceedings, it was submitted that Vinay had been booked in another case in HP, where the state CID had alleged that he had been duping and extorting money by posing himself as the IG, IB.

During Vinay’s bail application before the HP High Court, it came to light that the CID had submitted that Haryana Police officials, including Head Constable Raj Singh, Jail Warder Jasbir Singh and Constable Ravinder Singh, were deployed with accused Vinay at the behest of some senior police officials of Haryana.

Though the HP High Court had granted anticipatory bail to Vinay, it had commented that statements of accompanying police officials “give an impression that the Haryana Police officers/officials were acquainted with Vinay Aggarwal and were with him — deployed or otherwise. Some photographs have also been shown by the investigating agency (HP CID) to contend that the Haryana Police vehicles used to be part of Vinay’s convoy to facilitate him in extorting money from industrialists of HP”.

In the FIR registered at Sector 20 police station, Panchkula, Nishant’s anticipatory bail was dismissed by the Punjab and Haryana High Court as well as the Supreme Court. While dismissing the anticipatory bail application on April 11, 2023, the Supreme Court had asked Nishant to surrender before the trial court within four weeks. However, he did not surrender and continued to attend his office.

The Haryana Government Counsel had admitted in the Punjab and Haryana High Court that no steps had been taken by the state police to arrest Nishant. He did not dispute that three police personnel had been assigned duties with some senior IPS officers during the time they were allegedly escorting Vinay in HP.

While handing over the case to the CBI, Justice Manjari Nehru Kaul, in her order dated May 17, said the involvement of the three Haryana Police officials, who were neither on leave nor present at their official posting in Haryana when they were alleged to have been accompanying co-accused Vinay in HP, raised serious concerns about possible patronage being given by the high ranking police officials of Haryana.

“It is both shocking and very strange that these police officials, attached to the senior police officials in Haryana, were openly accompanying accused Vinay outside the State of Haryana,” said the judgment.
