Tribunal orders Rs 42L relief for kin of accident victim

Directs insurance firm to deposit amount in account of deceased's wife

The Motor Accident Claims Tribunal (MACT), Rohtak, has ordered the payment of compensation amounting to Rs 42,01,664 to the wife and two minor children of a man who was killed in a road accident in 2018.

The MACT court of Rajni Yadav held that the driver and the owner of the offending vehicle were the joint tortfeasors and are jointly and severally liable to pay the compensation amount to the petitioners, while the insurer of the offending vehicle was liable to indemnify the insured (the owner of the vehicle).

The tribunal has directed the representative of the insurance firm, IFFCO Tokio General Insurance Company, to deposit the amount of compensation in the bank account of the wife of the deceased within 30 days, failing which they would be liable to pay interest at the rate of 9% per annum with yearly rest from the date of institution till realisation.

Advocate Rakesh Kumar Sapra, the counsel for petitioner Kaveri Aggarwal, said they had filed the petition under Section 166 of the Motor Vehicles Act, 1988, for grant of compensation on account of the death of Rohit Garg in a road accident in Uttar Pradesh on July 8, 2018. The petitioner maintained that the driver was driving the vehicle rashly, due to which the accident took place. The vehicle owner and the insurance company were the other respondents in the case.
