Justice Sandeep Sharma issued the orders while disposing of a petition filed by Nirmala Devi and others. The government had pleaded for the postponement of the hearing in the case but was rejected. The court said that the examination in question was conducted by Sardar Patel University, Mandi, which is an autonomous body. The court also observed that the state government had no role in the matter.

The court held that once the examination for filling the posts of JOA (IT) was conducted by the university, being an autonomous body, there was no need for it to seek prior permission of the state government for declaring the results. In the case, the advertisement was issued on September 7, 2022, and thereafter the examination was held on October 20, 2022, in which 7,640 candidates had applied. The respondent university submitted that the results were ready and could be declared. However, the declaration of the results was deferred due to a communication issued by the state on December 26, 2022. The applicants submitted that thousands of candidates, who had applied for the posts in question, were eagerly awaiting the results. More than three years have elapsed since the examination was conducted but till date, without any plausible reason, the results are not being declared.
