Gudiya manch seeks fresh probe, threatens stir

The Gudiya rape and murder case, in which a minor schoolgirl was raped and murdered on July 4, 2017, and her body was recovered from Tandi forests in Kotkhai of Shimla district, is again in focus to haunt the government following evidence of two Assistant Directors of Forensic Laboratory (Gandhinagar) in the CBI Court, Chandigarh, that the number of accused could be more than one.

The Gudiya Nyaya Manch has asked the state government to take cognisance of the statements of the officers and order reinvestigation of the case. The manch has also threatened to revive the agitation if the demand is not accepted.

Definite effort to defend someone: Experts to CBI court

  • Two forensic experts revealed that more than one person could be involved in the Gudiya rape and murder case
  • Hemangi Shah, Assistant Director, Forensic Psychological Division, Gandhinagar, conducted polygraph test on those who were initially arrested — Ashish Chauhan, Rajinder Singh, Lokjan, Deepak and Subhash
  • Dr HV Acharya, Assistant Director, Forensic Science Laboratory, conducted narco and brain electrical oscillation signature profiling (BEOS) test on them.

  • During their deposition before the CBI Special Court, they said the “role of five accused is not observed in the tests”

  • The report also mentioned, “The motive of rape and murder of the minor girl is not established in any of the five subjects.”

  • Shah also stood by her observation that all six held initially and tortured by the police implied the “definite effort to defend someone”

Convener of the Gudiya Nyaya Manch Vijendra Mehra said the case had taken a new turn and the apprehensions that the case was not properly investigated by the CBI seemed to be coming true and the BJP, which had made it an election issue, must constitute a committee to go deep into the matter.

The CBI has completed its investigations and there was no hindrance in ordering a fresh impartial inquiry, he said, adding that the manch had been consistently saying that it was not the act of a single person but a heinous crime, premeditated gangrape and brutal murder.

Alleging that it was a conspiracy in connivance with political leaders and bureaucrats to save the real culprits, he said it was a game-plan of the police to arrest innocent persons and later release them to shift the focus from the main culprits and close the case by arresting a “Chirani”.

Even after two-and-a-half year, Gudiya has not got justice and a judicial inquiry by a High Court Judge should be ordered, he added.
