Transfer of Rampur Deputy Forest Conservator stayed

The Chandigarh bench of Central Administrative Tribunal has stayed the transfer order of Vikalp Yadav, Deputy Conservator of Forest (DCF), who claimed that he has been transferred fourth times in last two years. The applicant approached the CAT after he was again transferred within 15 days of his joining to Rampur.

Petitioner’s plea

Deputy Conservator of Forest claims he was transferred within 15 days of his joining to Rampur. This is fourth such transfer in two years.

While fixing the case before the Circuit Bench at Shimla on April 25 Suresh Kumar Monga, Member (J), Chandigarh Bench, CAT, has stayed his transfer order dated April 11, 2022.

The CAT has also issued notices to respondents to show cause as to why the original application be not admitted for hearing. The applicant Vikalp Yadav submitted that by way of an order dated January 01, 2020, he was posted as Deputy Conservator of Forest at Kotgarh, Shimla district. Just after a stay of nine months at Kotgarh, he was transferred to Nurpur, Kangra district on October 29, 2020. Before he could complete his tenure of two years at Nurpur, he was again transferred to Rampur on March 22.

Pursuant to order he gave his joining report at Rampur on March 25, 2022. Now, just after a period of 15 days, he has once again been transferred to Sarahan, Shimla district.

The applicant argued that order dated April 11, 2022 cannot be sustained it being contrary to the provisions of the Indian Forest Service (Cadre) Rules, 1966 and the principles laid down by the Supreme Court in TSR Subramanian and others Vs. Union of India and others.

“Let the respective written statements be filed by the respondents a day prior to the date fixed with advance copies to the applicant,” says the bench in the order.
