The Shimla district administration has directed all trusts being run in the district to strictly follow the rules laid down for the running of trusts.
These directives were issued by Deputy Commissioner Anupam Kashyap while chairing the review meeting of various trusts in the district here today. He said meetings should be held from time to time in the trusts and the rules under the Indian Trust Act 1882 should be strictly followed.
“Strict adherence to rules is a must for the proper operation of the trust. Under Section 34 of the Indian Trust Act 1882, there is a right to apply to the court to seek opinion in the management of the trust property,” he said. Any trustee can apply to the court by petition, without instituting a suit, to seek the opinion, advice or direction of the principal civil court with respect to the management of the trust property, he added.
Kashyap also said the members of various trusts about Section 73 of the Indian Trust Act 1882, which has a provision for appointment of a new trustee in case of death of a trustee. Whenever the person who has been appointed as a trustee refuses, dies or remains absent from India for a continuous period of six months or leaves India for the purpose of residing abroad, or is declared insolvent, or wishes to be discharged from the trust or refuses to act in the trust, then a new trustee can be appointed in his place, he explained.
He apprised the participants about other rules with regard to running of trusts.
