Privilege notice against Rahul for remarks on China

A day after his mother Sonia Gandhi attracted a notice of privilege from the BJP over her remarks on President Droupadi Murmu, leader of opposition in Lok Sabha Rahul Gandhi on Tuesday faced a similar notice in the lower house.

BJP MP from Jharkhand's Godda Nishikant Dubey in a notice of breach of privilege against Rahul to Lok Sabha Speaker Om Birla termed the leader of opposition's remarks during the speech on the motion of thanks on President's address to Parliament as "gibberish canards" which he failed to authenticate despite being asked by the chair to do so.

Dubey in his letter demanded that Rahul be reprimanded for alleged habitual falsifications on the floor of the House.

The letter mentioned Gandhi's remarks in Lok Sabha on Monday -- mobile phones are not made in India but only assembled here; Chinese troops are in forcible occupation of Indian land (refuted by Defence Minister Rajnath Singh); our country was not invited for US President Donald Trump's inauguration and alleged malpractice in Maharashtra elections -- and said Gandhi did not authenticate his statements despite being asked by the chair to do so.

"Rahul has not only shamelessly distorted the historical and substantive facts but also made an attempt to ridicule the country and lower the prestige of the republic," said Dubey, adding, "This erudite person has neither authenticated his gibberish canards nor apologised for using the forum of Parliament to defame the country and the elected government."

Dubey said his instant notice of breach of privilege was regarding the "habitual and blatant lies by Rahul Gandhi, misusing the sacred forum of Parliament on an utterly false and imaginary notion that he as an MP has an inherent right and privilege to speak whatever he likes on the floor of the house and even the presiding officer or the leader of the house or treasury benches have no authority to discipline his true and delinquent behaviour."

"It appears that Rahul Gandhi has misjudged Article 105 of the Constitution and has a false notion that this article gives him unbridled freedom of speech in Parliament, and a right to him to ridicule any authority on baseless charges, spreading hatred among communities and inciting the citizens to stand against the state. Rahul Gandhi is still intoxicated of having unbridled privilege of belonging to a "privileged gharana" but the fact remains that Article 105 of the Constitution does not give absolute powers of freedom to any public representative, especially of the ilk of Rahul Gandhi, otherwise, there would be anarchy in the house which would be devoid of decency and refined behaviour," Dubey said in his letter.

He urged the Speaker to initiate privilege proceedings against Rahul on urgent basis.

"I wish to emphasise that since Parliament records and proceedings are the testimony to his instant callous and irresponsible attitude...Rahul Gandhi may also be reprimanded in the current session of Parliament by way of a motion in terms of relevant provisions of the rules of procedure," said the BJP MP.
