Two Hizbul Mujahideen (HM) terrorists, who were facing trial for the past 22 years in a murder case, were awarded life imprisonment by a court in Ramban on Monday.
Principal Sessions Judge, Ramban, Deepak Sethi, awarded life imprisonment to Mohammad Mumtaz and Farooq Ahmed for killing a person in Gool of Ramban district in Jammu division in 2003.
On December 17, 2003, the police received information that unknown terrorists brought out Mushtaq Ahmed out of his house and killed him in cold blood. The terrorists also abducted one Zaheer Ahmed with an intention to kill them. A case was registered under Sections 121-A, 120-B, 302/364 RPC, and 7/27 Arms Act.
The police after completing the investigation found out that Mohammad Mumtaz and Farooq Ahmed absconded from the spot after committing the offence. It was found that the accused were members of the HM terror outfit.
Principal Sessions Judge Deepak Sethi after hearing both the sides observed that the antecedents of the convicts, particularly their surrender, their intentions to come back to the society, their family background, should be kept in consideration while deciding the quantum of sentence to be imposed.
“For the facts stated hereinabove I don’t think convicts Mohammad Mumtaz, and Farooq Ahmed can be awarded capital punishment prescribed u/s 302 RPC and sentence of life imprisonment for the offence u/s 302 RPC would be adequate,” the judge stated.
Both the convicts were sentenced to undergo 10 years imprisonment for the commission of offence.
