The Jammu and Kashmir administration has directed district magistrates in the Union Territory to review orders passed under Section 144 of the CrPC to assess the need for the same and ensure any orders passed under Section 144 were in conformity with the directions of the Supreme Court.
On January 10, the apex court had underscored the statutory obligation upon magistrate(s) to adhere to procedural requirements. It had said that Section 144 could not be used to suppress legitimate expression of opinion or grievance or exercise of democratic rights. —TNS
