Rules notified for grant of domicile in J&K

The UT Administration today notified rules for the grant of domicile certificate to its residents while prescribing the basic eligibility for getting any government job in Jammu and Kashmir.

All residents of the erstwhile J&K State, who were in possession of the permanent resident certificate (PRC) before October 31 last year, will get the domicile certificate in a“time-bound” manner on producing their PRC alone. They will not require any additional documentation.

Now, the children of West Pakistan refugees, safai karamcharis (Valmikis), displaced persons and migrants will also be eligible for obtaining domicile certificates and subsequently for government jobs in J&K.

“We are happy to announce that the government today notified the Jammu and Kashmir Grant of Domicile Certificate (Procedure) Rules 2020.

These rules prescribe the procedure for the issuance of domicile certificates and this has been made the basic eligibility for the appointment at any post under the UT following the amendment in the Jammu and Kashmir Civil Services (Decentralisation and Recruitment) Act 2010,” Rohit Kansal, Principal Secretary, Information, told the media here.

Flanked by senior officers and the Director (Information), J&K, Kansal said, “These rules provide simple, time-bound and transparent issuance of domicile certificates in such a manner that no category of person is put to any inconvenience. A time period of 15 days has been fixed for issuing the certificate. Thereafter, the applicant is free to approach the appellate authority whose decision will be final and will be binding on the competent authority for issuing certificates”.

“Whatever the appellate authority decides, it will be complied by the issuing authority within seven days failing which the defaulting officer will be liable to a penalty of Rs 50,000 which is to be recovered from his salary,” Kansal said.

The Principal Secretary said, “As per the Act (Jammu and Kashmir Reorganisation Act, 2019), a number of categories of people have become eligible for the grant of domicile certificates and these include people who have resided for a period of 15 years in the Union Territory or have studied for a period of seven years and appeared in Class X and Class XII examination in an educational institution located in the UT”.

However, he said the government would come out with separate rules with regard to purchase of land in the J&K Union Territory.

“These rules are primarily concerned with the recruitment in government services. These rules are for obtaining domicile certificates and thereafter they can apply for the government jobs. These rules don’t deal with those (land related) issues,” he said.
