ED officials counter Congress’ no-FIR claim

Countering the Congress’ claim that there has been no FIR or a scheduled offence in the National Herald case on the basis of which an Enforcement Case Information Report under the PMLA is registered, the ED said the action has been on a “higher pedestal than that of proceedings undertaken on the basis of the FIR” as court has taken cognisance of an Income Tax Department chargesheet.

Officials said Sections 120B (criminal conspiracy) and 420 (cheating) of the IPC applied in the income tax case were “predicate offences” that enable the agency to register case under the PMLA.
