The Supreme Court today refused to entertain Congress leader Randeep Singh Surjewala’s petition against linking of Aadhaar No. to voter identity cards, and asked him to approach the Delhi High Court.

“Why don’t you move the Delhi High Court? You will have the same remedy. You are challenging Sections 4 and 5 of the Election Laws (Amendment) Act, 2021. Why have you come here? You can go to the Delhi High Court,” a Bench led by Justice DY Chandrachud told his counsel.

As his counsel submitted that three states were to go to polls and there may be different orders from different high courts, the Bench said that in case of multiplicity of proceedings, the Centre could move the Supreme Court for clubbing and transfer of petitions. “If required, it can be clubbed and sent to one high court,” said the Bench, which also included Justice AS Bopanna, describing a petition under Article 226 as an “efficacious alternative remedy”.

Surjewala challenged the Election Laws (Amendment) Act, 2021, that enabled linking of electoral rolls with the Aadhaar eco-system.
