The Supreme Court on Wednesday asked its registry to submit a report on urgent listing of the petition challenging the RBI’s decision permitting citizens to exchange Rs 2,000 notes without any requisition slip or identity proof.
A Vacation Bench led by Justice Aniruddha Bose asked the Registry to submit a report on mentioning of the plea by petitioner advocate Ashwini Upadhyay, a Delhi BJP leader.
Earlier, the top court had turned down his plea for urgent listing of the matter, noting that it was not urgent and that it would be taken up in July, after the summer vacation.
As Upadhyay sought an urgent hearing again, Justice Bose said he would like to peruse the registry’s report first.
Upadhyay has challenged Delhi High Court’s order dismissing his plea against the RBI’s decision to allow exchange of Rs 2,000 notes without any requisition slip or identity proof.
The Reserve Bank of India (RBI) had on May 19 announced it would pull out the Rs 2,000 denomination from circulation as part of a “currency management exercise”. Although, the RBI has given citizens time till September 30 to exchange these notes with those of other denominations.
Seeking a stay on RBI and SBI’s notifications, Upadhyay contended it gave an opportunity to legalise illegal money and hence contrary to the aims and objects of the Prevention of Corruption Act, Benami Transactions Act, Money Laundering Act, Lokpal and Lokayukta Act, CVC Act, Fugitive Economic Offenders Act and the Black Money Act.
