Court initiates proceedings to declare Fazilka Improvement Trust chief proclaimed offender

The proceedings for declaring Fazilka Improvement Trust Chairman and AAP leader Mohinder Singh Kachura a proclaimed offender in cheque bounce case have begun.

In an order, the court of Amandeep Kaur, Additional Chief Judicial Magistrate, Fazilka, observed that warrants of arrest of accused Mohinder had been received back unserved. The judge observed that the accused was intentionally evading his appearance and his presence could not be procured through ordinary process.

Therefore, the proclamation of accused under Section 82 of the CrPC be issued for May 13, 2025. The court ruled that proclamation be affected within 15 days and executing officials be also summoned for the fixed date of hearing.

Earlier, non-bailable and arrest warrants were also issued against Kachura.

As per the petition filed under Section 138 of the Negotiable Instrument Act in the court of Additional Chief Judicial Magistrate, Fazilka, Kartar Chand, a resident of Arniwala Sheikh Subhan sub-tehsil of Fazilka district, stated that Kachura had borrowed Rs 2.25 lakh from him in August 2022 and agreed to return the amount in two months.

As per the complainant, the accused issued a cheque dated October 20, 2022, drawn on IDBI bank against the borrowed amount. Kartar deposited the cheque in the bank a week after the due date on October 27, 2022, but it was dishonoured as unpaid with remarks “account blocked”.

The complainant has alleged that there was no sufficient amount lying in the bank at the time of issuing the cheque by Kachura.

When contacted, Kachura told The Tribune that he was not aware of any such case lying pending in the court thus, he was not in a position to comment on the issue. He, however, said that some persons, with an intension to blackmail him, had been defaming him by uploading his personal videos on social media.
