RS panel miffed at notifications delay



New Delhi, December 15

Taking a serious view of delay by ministries in presenting statutory notifications to the House in violation of rules, the Committee on Subordinate Legislation of the Rajya Sabha has expressed displeasure over not attaching ‘delay statements’ explaining the reasons.

The committee with a mandate to monitor notifications laid or not before the House is headed by T Subbarami Reddy. In its latest report tabled last week, the committee came up with its analysis, findings and recommendations.

As per the rules, all Statutory Rules and Regulations flowing from the provisions of respective Acts and known as Subordinate Legislations and notified by the government are required to be laid on the table of the House within 15 days of their publication in the gazette if the House is in session and if not, within 15 days of commencement of the next session.

Such notifications shall be laid on the table for 30 working days either in a single session or stretched over to the next sessions.

During these 30 days, members of the House can move motions for either modification of the Rules and Regulations or for their annulment. Delay in laying of such notifications and thereby denying the members an opportunity to seek modification may result in implementation of questionable rules and regulations during the period of delay. — TNS
