High Court: IPS officer Y Puran Kumar’s petition infructuous

The Punjab and Haryana High Court today disposed of as infructuous a petition filed by IPS officer Y Puran Kumar for quashing preliminary inquiry initiated on his complaint against Director-General of Police Manoj Yadava.

The order by Justice Manoj Bajaj came after the Bench was told that the inquiry stood concluded. The Bench was also told the inquiry report, dated May 28, had been challenged by the petitioner separately through another petition. As such, the petition before the Bench had been rendered infructuous.

Preliminary inquiry

Y Puran Kumar had filed a petition for quashing of preliminary inquiry initiated on his complaint against DGP Manoj Yadava

Kumar had filed the petition for the quashing of the preliminary inquiry as it was violative of Section 18-A of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989. Directions were also sought to the respondent to act in accordance with law. Alternatively, it was prayed that the investigation of the case be handed over to any other independent agency.

Appearing before the Bench, his counsel stated that the petitioner had challenged the initiation of the inquiry by Senior Superintendent of Police, Ambala, but it stood concluded. “In view of the statement made by counsel for the petitioner, the petition is disposed of as infructuous,” Justice Bajaj concluded.
