Chandigarh, July 5
Rajeev K. Beri, Additional Sessions Judge, Chandigarh, has acquitted a 29-year-old youth, Puneet Kapoor, alias Baba, after the prosecution failed to prove charges. He was arrested for allegedly attacking a person outside a club four years ago.
The police registered a case against the accused for the offences punishable under Sections 354, 324 and 308 of the IPC on April 15, 2018 on the complaint of Karamjeet, a resident of Sonipat, Haryana.
In his complaint, Karamjeet said on April 14, 2018, he, along with his girlfriend, went to Ministry of Bar Exchange, Café and Lounge, Sector 26, Chandigarh. After finishing their meal, they came out of the Bar at 12.30 am. A boy started teasing his girlfriend. He forbade him from doing so, but he picked up an empty bottle of liquor, broke it and gave a blow on his abdomen. He then attacked him on his shoulder and head. He said he learnt about the name of Puneet of Sector 22, Chandigarh.
The police arrested the accused. After the completion of investigation, a challan was presented against him in the court. After finding a prima-facie case against him, the accused was chargesheeted under Sections 354 and 308 of the IPC to which he pleaded not guilty and claimed trial.
Rabindra Pandit, counsel for the accused, contended that there was no incriminating evidence against him. None of the examined prosecution witnesses had attributed the alleged act to the accused nor identified him. He said it was the accused who intervened to save the complainant from attack by others. As a result, he also suffered injuries.
After hearing the arguments, the court acquitted the accused of all charges. The court said the victim also denied that she was ever eve-teased by the accused.
