Man acquitted of brother’s murder as mother turns hostile

CHANDIGARH: A local court today acquitted a man in a murder case after the complainant turned hostile.

A local court today acquitted a man in a murder case after the complainant turned hostile. The complainant was also mother of both accused and deceased.

The accused was charged under Sections 302 and 201 of the IPC. Also, the motive behind the murder could not be proved which led to the acquittal of the accused.

Malkiat Singh, a resident of Mauli Jagran, was accused of murdering his own brother on March 30, 2016. Dayalo approached the police and complained that her son named Amrik Singh was stabbed to death by her son Malkiat. According to the complaint, Amrik had asked Malkiat for some money. Malkiat gave Rs 500 to Amrik. After sometime, Amrik again came and demanded more money. However, Malkiat refused and an argument ensued. In a fit of rage, Amrik hit Malkiat with a rod on his head, and in response, Malkiat stabbed Amrik with a knife. Amrik was then taken to a hospital where he was declared brought dead.

Defence counsel Inderjeet Bassi, however, argued that the accused was being falsely implicated in the case. The mother also turned hostile in the court and stated that at the time of recording the statement, she was in state of shock, hence could not depose properly. She also stated that she could not understand what was asked and simply gave a thumb impression on paper without understanding the same.
