UPSC told to consider HCS officer’s plea

CHANDIGARH: The Central Administrative Tribunal (CAT) has directed the UnionPublic Service Commission (UPSC) and the Haryana Government to consider the claim of an HCS officer for induction into the IAS.

The Central Administrative Tribunal (CAT) has directed the UnionPublic Service Commission (UPSC) and the Haryana Government to consider the claim of an HCS officer for induction into the IAS.

In a petition, Virender Singh Hooda submitted that the Haryana Public Service Commission (HPSC) issued an advertisement in 1989 for appointment to the Haryana Civil Services (Executive Branch), and the result was declared in June 1992.

Meanwhile, the number of vacancies for the general category was seven. However, his name wasat serial number 9 inthe category.

Later in November 1992, the HPSC sought to fill 12 more vacancies and since the notification for nine vacancies for the HCS was issued within six months of declaration of the result in 1992, the subsequent vacancies were to be filled from the recommendations made in June 1992.

Hooda submitted thathe joined the HCS (EB)in December 1999, but with effect from 1992,he had completed 20years of service andthus he was entitled to promotion to the IAS in terms of the Indian Administrative Services (Appointment by Promotion) Regulations.

Hooda pleaded that his name was recommended for promotion in 2015, but the Haryana Government and the UPSC, while issuing notification in May 2019 relating to the appointment of HCS officers to the IAS, did not include his name in the list because he retired on February 28, 2019.

After hearing the arguments, the tribunaldirected the HaryanaGovernment and the UPSC to take a call and consider the claim ofHooda for induction into the IAS within a periodof one month.
