Robbery: 3 acquitted for want of evidence

CHANDIGARH: A local court today acquitted three persons of the robbery charge for lack of evidence.

A local court today acquitted three persons of the robbery charge for lack of evidence.

Vikas Kumar, Brijesh Kumar and Kuldeep Singh, all residents of Maloya, were acquitted after multiple discrepancies emerged between the statements of the police and the complainant.

The three were booked on December 30, 2015, under Sections 392, 411 and 34 of the Indian Penal Code.

The complainant, Manoj Kumar, had claimed that on December 30, 2015, at around 8.30 pm, he was passing by the Maloya post office when three youth blocked his way and took him to the jungle area on knifepoint. They robbed him of his wallet and mobile phone before fleeing, the complainant added.

The very next day, the police arrested Vikas, Brijesh and Kuldeep from Maloya for the crime.

As per the defence counsel, Ankur Chaudhary, the police had claimed to have recovered the items but these were not sealed. He added that the complainant could not prove the ownership of the phone.

Yet another loophole surfaced when the complainant told the court that the identification parade was never conducted by the police, neither did he know from where the arrest was made.

Also, Manoj admitted in the court that the signatures on the complaint were not his.

All these factors led to the acquittal of the three.
