Panel provides big relief to residential plot owners

The panel of three retired HC Judges constituted to decide liability of enhanced compensation has given major relief to residential plot owners and group housing societies in 18 districts.

The Haryana Shehri Vikas Pradhikaran (HSVP) demanded enhanced compensation after courts allowed the plea for higher compensation of farmers whose land had been acquired.

The panel recommended that enhanced compensation in respect of common area was to be distributed proportionately on all categories of sites. The Tribune has a copy of the report.

According to the report, the public had no liability for facilities like public library, cremation and burial ground, stadium and sports complex, cattle pound, old-age home, working women’s hostel, slaughterhouse, fire station, substation and auditorium.

The cost under EWS plots had to be borne by the government and “not those other than EWS”. The panel of Justice Pritam Pal, Justice Raj Rahul Garg and Justice Dr BB Parsoon was constituted on October 1 last year.

“The HSVP is yet to implement the recommendations, but plot owners have been protesting for recalculation of enhanced compensation based on the report,” said Yashveer Malik, convener of the Haryana State HUDA Sectors Confederation.

The panel recommended that compensation had to be paid for community centres, waterworks, sewage treatment plants, underground sewerage and storm water drainage. It was the same with parks, children’s parks, greenbelts, roads, tubewells, bus queue shelters and solid waste treatment plants.

Enhanced compensation in respect of gymkhana clubs, milk booths, Housing Board, Haryana Warehousing Corporation, Haryana State Roads Development Corporation and Dairy Development Corporation could not be offloaded, recommended the panel.

For area covered under high-tension lines, gas godowns, CNG and petrol stations, government communication zones, taxi stands and farmers’ day markets, compensation would not be a liability for saleable area owners or lessees.

The panel rejected the case of enhanced compensation in case of 76 acres in the Ghaggar area in Panchkula, for which residents of sectors 24 to 28 were made liable.
