Ex-Dy Mayor, kin acquitted in assault case

CHANDIGARH: After facing a trial for five years, former Deputy Mayor Anil Dubey, his brother Rakesh Dubey, the then BJP block president, and Shanu Dubey, son of Anil Dubey, have been acquitted by a local court in an assault case as the prosecution failed to prove its case beyond reasonable doubt.

After facing a trial for five years, former Deputy Mayor Anil Dubey, his brother Rakesh Dubey, the then BJP block president, and Shanu Dubey, son of Anil Dubey, have been acquitted by a local court in an assault case as the prosecution failed to prove its case beyond reasonable doubt.

On November 18, 2014, the three were booked by the police under Sections 323, 341, 506 and 34 of the IPC on a complaint of Rakesh Rai, a resident of Mauli Jagran.

In the complaint, Rai had stated that he was heading home on a motorcycle from the Industrial Area, Phase 1, on November 17, 2014. When he reached near a turn at Darwan around 10 pm, he noticed that a car was continuously honking at him. In the meantime, the car reached near him and started moving parallel to his motorcycle. He said Anil tried to grab him and took out his revolver. Looking at this, the complainant increased the speed of his motorcycle and fled, but the car kept on following him. After reaching the vegetable market at Vikas Nagar, Anil caught hold of him and started hurling abuses and also threatened him with dire consequences.

When he again gathered courage and tried to ride his motorcycle to go home, Anil hit his motorcycle with his car following which he fell down. Rakesh and Shanu joined and started assaulting him. Shanu threw a brick at him and both Shanu and Rakesh attacked him again with his helmet. Later, they fled in the car.

  Defence counsel AS Gujral argued that the accused were falsely implicated and it was also stated that the prosecution failed to present any independent witness in the court to prove its case. 

  Defence witness Arvind Kumar submitted in the court that his house was just next to the place where the alleged incident took place, but on the said date, no such quarrel took place and he was there from 6 pm to 11 pm and he saw nothing as alleged in the compliant. After hearing the arguments, the court acquitted the accused.
