CJM tells Gharota SHO to register FIR in rape case

JAMMU: A Station House Officer (SHO) has been ordered by the Chief Judicial Magistrate (CJM) to register an FIR in a rape case after the victim approached him for the same.

A Station House Officer (SHO) has been ordered by the Chief Judicial Magistrate (CJM) to register an FIR in a rape case after the victim approached him for the same.

After refusal from the SHO, Gharota, Rakesh Bhagat, the complainant had to approach the CJM, Jammu, for the registration of an FIR.

As per the complaint of the victim, on July 21 Younis Ali, a resident of Dhar Darochan, Bhalwal tehsil, Jammu, raped her when she went to her maize field to shoo away cattle of Younis Ali, which had entered her field.

She told the CJM that Ali had already made plans to rape her and was hiding in the maize field. “When Ali found her alone, he got hold of her and raped her,” the complaint said.

She accused Ali of injuring her during the act and it was only after one Asia Bibi reached the maize field after hearing her cries that Ali fled the area.

In her complaint to the CJM, she said she along with her husband went to the Gharota police station for the registration of an FIR, but the SHO didn’t pay heed to their request. They even approached the SSP, Jammu, but to no avail.

She claimed that after rape, Younis Ali was regularly making threatening calls to her and had asked her to withdraw her complaint.

Acting on the complaint, the CJM has forwarded the same to the SHO, Gharota, for necessary action under Section 156 (3) of the CrPC.

When SHO, Gharota, Rakesh Bhagat was asked why he didn’t register an FIR against Ali, he said the complainant didn’t visit her to register an FIR in rape case. “She came to me with a complaint against Ali for destroying the crop and there was no mention of any rape in the complaint,” Bhagat said.
