Auto driver gets jail for negligence

CHANDIGARH:A local court awarded one year imprisonment to a driver of an auto-rickshaw for causing death due to negligence in 2014 after a passenger fell off his vehicle.

A local court awarded one year imprisonment to a driver of an auto-rickshaw for causing death due to negligence in 2014 after a passenger fell off his vehicle. 

A Raipur Khurd resident Madan Kumar was held guilty under Sections 279 (Rash and negligent driving) and 304-A (Causing death by negligence) of the IPC.

On the night of July 28, 2014, the police received information that a young boy had met with an accident near Elante Mall. The boy was rushed to the GMCH, Sector 32, and a complaint was filed by Karan Verma of Sangrur, who along with Amit worked at Vans Kapsons store at Elante Mall. Both had taken a three-wheeler on their way back home at around 11:30 pm. They had felt that its driver was driving rashly and had pointed it out to him too. 

When the auto-rickshaw took a U-turn near Industrial Area, Phase 1, at high speed, Amit fell on the road. Verma noted down the vehicle’s number. Amit was taken to the Government Medical College and Hospital (GMCH), Sector 32, where he succumbed to his injuries. 

Charges were framed against Madan under Sections 279, 304-A of the IPC and Section 3/181 of the Motor Vehicles Act on July 31, 2015.
