Project manager of firm held for misappropriation of raw material

AMRITSAR: The city police have arrested Nishchal Tyagi, project manager of Simmro Infrastructure and Developers Private Limited, in a case related to misappropriation of raw material and machinery belonging to a Delhi-based firm CCC Infrasys Private Limited.

The city police have arrested Nishchal Tyagi, project manager of Simmro Infrastructure and Developers Private Limited, in a case related to misappropriation of raw material and machinery belonging to a Delhi-based firm CCC Infrasys Private Limited. He was produced in the local court, which sent him to judicial remand.

Tyagi was booked by the Sultanwind police along with chairman and director of the company, identified as Balbir Singh Kakkar and Majid Akhtar, respectively, on charges of theft (Section 379 of the IPC), criminal breach of trust (Section 406 of the IPC), criminal intimidation (Section 506 of the IPC) and common intention in the criminal act (Section 34 of the IPC).

CCC Infrasys Private Limited had lodged a complaint with the local police that it received work order for the construction of the multi-storey building at Shubham Enclave from Simmro Infrastructure and Developers Private Limited in November 2013. However, the work got delayed due to non clearance of mining and environmental certificates, besides due to additional work assigned by the company.

Officials of the company alleged that since September 2015 Simmro Infrastructure did not clear bills and started misbehaving with its officials. Officials alleged that the accused withheld their payments to the tune of Rs 3.5 crore. They said the accused also threatened them not to enter the site again. “Simmro Infrastructure has hired another contractor for the work, besides misappropriating our construction raw material worth Rs 54.8 lakh and machinery of Rs 47.26 lakh,” added officials of CCC Infrasys Private Limited.

Additional Deputy Commissioner (crime) Lakhbir Singh, who conducted the probe in the case, found prima facie evidence against the accused. In the enquiry report he stated that officials of Simmro Infrastructure, including Nishchal Tyagi and director (finance) Majid Akhtar, used the embezzled machinery and material at the behest of the director of the company. The legal opinion sought by the police also recommended prima facie case under Sections 406, 379, 506 and 34 of the IPC against the suspects.

While confirming arrest of Tyagi, Sultanwind police station additional SHO Jaspal Singh said he was sent to judicial custody.
