To ensure the alleged offenders in the sedition case of Jawaharlal Nehru University do not escape from the punishment, Delhi Police Special Cell has gathered three types of evidences.

On Monday, the chargesheet filed in the Patiala House Court has evidences recorded in different categories.

Against Kumar, Syed Umar Khalid and Anirban Bhattacharya, apart from sedition, charges of illegally becoming part of crowd, riot, committing crime by illegal gathering and criminal conspiracy under respective sections have been framed. While Kumar have also been alleged of beating, Khalid has been alleged for  using forged documents as original in the chargesheet. A form of verbal evidence, witnesses have been kept, a senior Special cell officer said.

As documentary evidences for the sedition, there are programme consent letters demanded by Umar with his signature and name. The CFSL report said that in the chargesheet under Section 161 and in the court under Section 164, few statements have also been recorded, he said.

The witnesses in their statement have told that Kumar was shouting anti-national slogans. Not only this, he in an illegal way near the Sabarmati Dhaba in JNU had supported and organised cultural eve programme against the death penalty of Afzal Guru, the officer said.

Kumar was suspended by the university seeing his role. As per the technical evidences, the eye witnesses have recognised him in the video clip (not yet disclosed to public), he said.

There is an SMS sent by Khalid to Kumar on the night of the incident, asking the latter  to come soon near Sabarmati Dhaba as the JNU administration had cancelled the permit to conduct the programme. Though, that SMS was deleted, but in the forensic test, the SMS was recovered by the cyber cell. Apart from this, Kumar’s mobile location is also there, he said.

Khalid had arranged loud speaker and mic for the programme, they said.

The CFSL report stated that on the letter, Khalid had forged signature of Bhattacharya and Ashwathi Nair. Khalid’s name was written on the pamphlets as an organiser of the programme as well.

As per the mobile call detail record, Khalid, Bhattacharya, Muzeeb Hussain Gattu, Muneeb Hussain Gattu, Umer-Zee-Ul — all these were continuously in contact of Kumar. All found shouting anti-national slogans and supporting the protestors were found in the video footage, officer said.

Apart from this, seven Kashmiri students — Akeeb Hussain, Bashrat Ali, Muzeeb, Umer-Zee-Ul, Muneeb, Raees and Khalid Basheer Bhatt — are there in the chargesheet as prime suspects, whose mobile phones location and in video footage, some photos are captured shouting the anti-national slogans, the officer added.
