The Motor Accident Claims Tribunal (MACT), Chandigarh, has directed an insurance company, driver and the owner of a motorcycle to pay Rs. 17,15,500 to the wife, three children and mother of a person who died in an accident two years ago.
The claimant woman, Ravinder Kaur, and others filed the petition under Section 166 of the Motor Vehicles Act, 1988, through counsel Kultar Singh Bhangu. In the petition, the claimants, all residents of Bakkarwala in Chhachhrauli tehsil of Yamuna Nagar district, said her husband Rajinder Singh died in the accident on October 29, 2020. They said Rajinder Singh had gone to the Partap Nagar grain market to sell his paddy crop. She said he was riding a motorcycle. When he reached near Yakubpur village, another person riding a motorcycle at a high speed, hit him. He fell on the road and suffered multiple injuries on his head, face and other parts of the body. Rajinder Singh was taken to the Civil Hospital, Jagadhri, where he was declared brought dead. An FIR was registered for offences under Sections 279 and 304A of the Indian Penal Code.
The claimants said Rajinder was working as a clerk with a timber merchant in Jagadhri and also having agricultural land in Bakkarwala village. He was managing the family being the sole breadwinner.
On the other hand, the respondents denied all charges. The insurance company also filed a separate written statement raising preliminary objections regarding the maintainability of this petition.
After hearing the arguments, Rajeev K Beri, presiding officer, Motor Accident Claims Tribunal, Chandigarh, allowed the claim petition and said all respondents were jointly and severally liable to pay to the claimants Rs. 17,15,500.
