HC restrains state from issuing CLU licences in Gurgaon

CHANDIGARH: The Punjab and Haryana High Court today once again directed the Haryana government against issuing CLU licences in Gurgaon and in its part of the National Capital Region.

The Punjab and Haryana High Court today once again directed the Haryana government against issuing CLU licences in Gurgaon and in its part of the National Capital Region. The government was also restrained from acquiring land till it obtained approval for the sub-regional plan from the NCR Planning Board.

The orders were passed after the High Court was informed that the state authorities were issuing new licences despite deficiencies in its sub-regional plan. The Division Bench of Justice Satish Kumar Mittal and Justice Deepak Sibal also asked the state authorities to submit the details of licences issued after the initial restraint orders were issued by the High Court on January 23, 2014.

Taking up the matter, the High Court had on that date directed against the issuance of fresh licences to builders and had stalled further land acquisition process in its part of the NCR till the notification of the sub- regional plan.

The directions were issued on a petition filed by Rishi Dagar and Chandra Shekhar against the Union of India and other respondents after the High Court was informed of the construction activity going on in the NCR region without the notification of the mandatory sub-regional plan.

At that time, TC Gupta, Financial Commissioner and Principal Secretary, Haryana, had sought two month more for approval of the sub-regional plan. Taking note of the assertion, the Bench had passed the orders against issuance of licences and acquisition process till the approval and notification of the plan.

The petitioners in this case had earlier challenged the proposed master plan 2025 and 2031 for Gurgaon. It was argued that the state’s move to prepare the master plan without approval and notification of the sub-regional plan was violation of the NCR Planning Board Act, 1985.
