Panel wants one-window solution for inter-country removal, retention of kids

CHANDIGARH: A multi-member committee set up by the Union Ministry of Women and Child Development, headed by Justice Rajesh Bindal of the Punjab and Haryana High Court, has recommended the establishment of an “Inter-Country Parental Child Removal Disputes Resolution Authority”.

A multi-member committee set up by the Union Ministry of Women and Child Development, headed by Justice Rajesh Bindal of the Punjab and Haryana High Court, has recommended the establishment of an “Inter-Country Parental Child Removal Disputes Resolution Authority”.

In its report submitted to Union Minister for Women and Child Development Maneka Gandhi, the committee suggested the setting up of the authority after stressing the need for mediation as the first step. The authority has been envisaged to provide a single window solution in cases of inter-country removal and retention of children.

The committee also recommended that the authority may be chaired by a retired HC Judge, with members from legal and social sector background, along with representatives from key ministries.

The committee further recommended that the authority may examine the inter-country cases of removal and retention of children with reference to the cultural context, merit of the case, and the best interest of the child. The panel also submitted draft legislation to the government. The ministry will be sharing the report with the Ministries of External Affairs, Law and Home Affairs for their comments and inputs.

“Protecting rights of parents and children has become a critical issue of national and international importance due to rise in transnational marriages,” said Meenaxee Raj, HCS officer-cum-committee member-secretary. — TNS
