Cabinet adopts Central clinics Act

CHANDIGARH: The Cabinet today gave its nod to the Haryana State Administrative Tribunal (Procedure) Rules, 2017, paving the way for setting up of the State Administrative Tribunal (SAT) while deciding to promulgate an ordinance for adoption of the Clinical Establishments (Registration and Regulation) Act, 2010, enacted by the Central government, to ensure ethical medical practices in treatment and patient care.

The Cabinet today gave its nod to the Haryana State Administrative Tribunal (Procedure) Rules, 2017, paving the way for setting up of the State Administrative Tribunal (SAT) while deciding to promulgate an ordinance for adoption of the Clinical Establishments (Registration and Regulation) Act, 2010, enacted by the Central government, to ensure ethical medical practices in treatment and patient care.

The Cabinet, which met under Chief Minister Manohar Lal Khattar, approved the SAT Rules, 2017, to provide quicker redress of employees’ grievances or service matters and to reduce the pendency of cases in the High Court.

With a view to bringing out uniformity in holding the Haryana Civil Service (Executive Branch) and Allied Services Examination, the Cabinet also decided to include the post of Naib Tehsildar in the examination.

Meanwhile, the promulgation of an ordinance was necessitated because at present, there was no legislation in the state to regulate and register clinical establishments in order to ensure minimum standards of facilities and services for providing quality health care. The ordinance would cover clinical establishments having more than 50 beds.

Addressing a press conference after the meeting, Finance Minister Capt Abhimanyu said various stakeholders, including the Indian Medical Association, Haryana unit, had urged that small clinical establishments having up to 50 beds be initially exempted from applicability of the Act.

At present, they lacked the capacity and preparedness to comply with provisions of the Act. Such establishments were usually managed by a single doctor and it would be difficult for them to fulfil the requirements of the Act.

The Cabinet decided to notify multiplication factor in case of rural areas, by which market value so determined by the Collector was to be multiplied to arrive at final compensation as provided under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Equivalent of the same would be given as solatium, in addition.

In case of rural areas, any part of the particular ‘killa’ on part thereof, as the case might be, of the land to be acquired up to 10 km, the factor would be 1.25. In case of between 10 km and 20 km, the factor would be 1.50. Similarly, the factor would be 1.75 for a distance of between 20 km and 30 km. The factor would be 2 for more than 30 km.

The Haryana Government would now be able to form a new non-banking financial company named Haryana State Financial Services Limited to act as in-house treasury manager for efficient management of surplus funds of state public enterprises and autonomous bodies of the state.

With a view to achieving the objective of ‘Housing for All’ and maximising the benefit to intended beneficiaries identified under Pradhan Mantri Awaas Yojana (PMAY), the Cabinet decided to make provisions for inclusion of PMAY urban beneficiaries in the existing Affordable Housing Policy, 2013.

Capt Abhimanyu said as per the amendment, any person could apply under the policy. However, the PMAY beneficiaries, identified by the Urban Local Bodies Department, would be granted preference in allotment.

First priority would be given to identified beneficiaries of the said town, followed by other PMAY beneficiaries of the state.

  • The Motor Vehicle (Taxation) Act, 2017, amended to revalidate the tax collected between September 19, 2016, and March 31, 2017, revise penal interest from 1.5 per cent to 1 per cent and grant exemption from liability to pay the tax in prospective or retrospective effect

  • Approval of draft of the Haryana Compassionate Assistance to the Dependents of the Deceased Government Employee (Amendment) Rules, 2017
